When Private Mediation Fails
Tips for Lawyers and Thieves on how to Maximize Profits
This Trick was taught to me by the Three Little Pigs, and by three Lawyers whose names are William M. Benjamin, Robert W. Lesh, and Richard Kolek ... along with a Judge who had never even heard of the 6-week co-parenting class sponsored by Family Court Services: the class that Dr. Robert J. Fox said he thought that "everyone had to take."
Anyway, the trick to this trick is to not tell the parent, or parents, what you are up to.
For example, when a parent walks out on a Do-Little (to fix anything) Private Mediator who was milking another case for ALL it was worth, do everything possible to slander and malign the parent who walked out, while covering up for the parent who was abusing the snail-paced / multi-year / "mediation" process, AND for the mediator who was not happy about receiving a pay cut. In other words, rather than dump what was not working -- in either the parents, or the child's best interest -- you simply point fingers at the parent who was being abused and compel the Judge to appoint another mediator / therapist: or even two of them. At the same time, appoint another attorney who works for the State: preferably one who is also a Private Lawyer who knows the other players.
Do NOT tell the parents about High Conflict Resolution, nor that you simply want to keep doing what just failed. In other words, you get the Judge to Order up more "Private Mediation" under a different name: i.e. "Couples Therapy," or "Co-parenting Therapy," or simply "Therapy." And this you do until ALL the MONEY is gone.
It's that simple.
